Ignoring issues with a child support order, parenting plan, or divorce decree can create larger legal and financial problems over time. What may start as a missed payment or small disagreement can quickly escalate if it isn’t addressed properly.
Taking action early can help you avoid unnecessary stress, conflict, and legal consequences.
Here’s what’s at stake:
1
Unpaid child support or spousal maintenance can accumulate into significant financial obligations, including interest and penalties
2
Ongoing violations of a court order may weaken your position if the issue continues without formal enforcement
3
Informal agreements with your ex-spouse may not be enforceable unless they are approved by the court, especially if they are cross-border agreements
4
Delays in filing a modification can result in missed opportunities to adjust support or custody arrangements
5
Repeated conflict with the other parent can negatively impact long-term co-parenting and stability for your children
6
Escalation of disputes may lead to more complex legal proceedings, including contempt of court actions
Addressing these issues proactively allows you to protect your financial stability, maintain consistency for your children, and avoid more serious legal complications down the road.
If your current court order no longer reflects your life (or isn’t being followed) you don’t have to manage a complex legal system by yourself. The divorce attorneys at Pursuit Family Law can help you take the right legal steps to enforce your rights, update outdated terms, and move forward with greater stability and control.

You qualify for post-divorce modifications in Washington State if there has been a substantial change in circumstances, such as a significant income shift, job loss, relocation, or changes affecting your child’s needs. The court will evaluate whether the change is material and ongoing, not temporary. Our divorce attorneys can evaluate your case and discuss your options with you.
Unpaid child support can often be enforced retroactively, meaning you may be able to recover past-due amounts, depending on the terms of your court order and how long payments have been missed. Interest and additional penalties may also apply.
If your ex refuses to follow the divorce decree, we can help you file a motion to enforce the order or pursue a contempt of court action. The court may impose penalties such as fines, payment enforcement, or other remedies to ensure compliance.
Child support or spousal support can sometimes be adjusted by agreement between both parties, but to be legally enforceable, the changes must be approved by the court and reflected in an updated court order.
A modification or enforcement case timeline depends on complexity, but many cases take several weeks to a few months, especially if hearings or contested issues are involved. Emergency enforcement actions may move more quickly.
If the other parent moves out of state or internationally, enforcement may still be possible through interstate or cross-border legal processes. Washington courts can work with other jurisdictions to enforce support and custody orders, but the process can be complicated, so getting our legal team involved early can help. We collaborate with overseas legal representatives to help facilitate a smoother process.
You typically need to go to court for formal modification or enforcement, especially if the other party does not agree. However, some issues can be resolved through negotiation before a hearing is required.
You will generally need a certified copy of your divorce decree, current financial records, payment history, and any documentation showing the change in circumstances or non-compliance with the original order. Contact us for more specific information about your case.
