Helping Navigate Parental Moves and Child Relocation With Minimal Disruption

Relocation cases can place parents in a difficult position. One parent may have a new job, family support, housing opportunity, or other reason to move. The other may be concerned about losing regular residential time and an important part of their child’s daily life.

Washington has a specific legal process for relocating a child when a court order governs residential time or visitation. Depending on where the move is planned and the existing parenting arrangement, the relocating parent may need to provide formal notice. In contrast, the other parent may have a limited period to object.

Pursuit Family Law helps parents address relocation matters involving:

  • Moves outside a child’s current school district
  • Out-of-state and long-distance relocation
  • International moves involving Washington parenting orders
  • Objections to a proposed relocation
  • Changes to residential time and parenting schedules
  • Temporary orders while a relocation dispute is pending
  • Long-distance parenting arrangements after a move

A relocation and move-away custody lawyer can help you understand what your existing parenting plan requires, identify important deadlines, and build a strategy around the practical impact the proposed move could have on your child and your family.

What Can Affect a Washington Child Relocation Case?

A relocation case is more complicated than whether or not one parent has a good reason to move. Washington courts consider how the proposed relocation could affect the child, the relocating parent, and the child’s important relationships.

For many relocation cases, Washington law creates a rebuttable presumption that the intended relocation will be permitted. The person objecting may seek to overcome that presumption by showing that the detrimental effect of the relocation outweighs its benefits to the child and relocating parent. When parents have substantially equal residential time, however, that presumption does not apply, and the court makes its determination based on the child’s best interests using the statutory relocation factors.

Factors that may shape the court’s decision include:

  • Your child’s relationships: The court may consider the strength, quality, stability, and extent of the child’s relationship with each parent, siblings, and other significant people in the child’s life.
  • The reasons for seeking or opposing the move: The court can consider each party’s reasons and whether the request or objection is being made in good faith.
  • Your child’s age and individual needs: Developmental stage, educational needs, emotional well-being, and any special needs may affect how a proposed move is evaluated.
  • Life in the current and proposed locations: Resources, opportunities, school considerations, and the quality of life available to the child and relocating parent can be relevant.
  • The ability to preserve the other parent’s relationship: The court may consider whether alternative arrangements, including longer school-break visits or other changes to residential time, can maintain meaningful contact with the non-moving parent.
  • The practical and financial impact of the move: Distance, transportation, travel costs, work schedules, and other logistical realities can influence whether a proposed parenting arrangement will actually work.

Our relocation lawyers can help connect the legal factors to the realities of your child’s life, rather than treating the case as a dispute about distance alone.

FAQs About Child Relocation and Move-Away Custody in Washington

How much notice do I have to give before relocating with my child in Washington?

If you plan to relocate your child outside the school district where the child currently resides the majority of the time, Washington law generally requires at least 60 days’ notice before the intended move. Different timing requirements may apply when the move could not reasonably have been anticipated that far in advance. A relocation and move-away custody lawyer can help you review your existing parenting plan, prepare the required notice, and address proposed changes to residential time before the move.

After receiving proper relocation notice, you generally have 30 days to file an objection with the court and serve the relocating parent. If you do not object within the required timeframe, the relocation may generally proceed without a contested relocation hearing, subject to applicable exceptions. If you oppose the move, acting quickly gives your attorney time to evaluate the proposed relocation, prepare the objection, and address any necessary changes to the parenting plan.

After a parent files and serves a timely relocation objection, the court may need to decide whether the child may relocate. The case may also involve a request for a temporary order addressing where the child will live while the dispute is pending. Parents may negotiate or mediate alternative arrangements before a hearing or trial. If they cannot agree, a judge considers Washington’s statutory relocation factors and the evidence presented by both parties before making a final decision.

Generally, you cannot object to the relocation itself under Washington’s relocation statute when the child will remain within the same school district where the child currently resides the majority of the time. The relocating parent must still provide actual notice to people entitled to residential time or visitation under a court order. However, if the move significantly affects transportation, exchanges, childcare, or residential time, it may still be appropriate to seek a modification of the existing parenting plan.

Yes. Washington relocation law can still apply when parents have substantially equal residential time, but the legal analysis is different. Under current Washington law, substantially equal residential time includes arrangements in which each parent has at least 45% of the child’s residential time. In these cases, the statutory presumption favoring relocation does not apply. Instead, the court determines whether relocation is in the child’s best interests after considering the statutory relocation factors.

You generally should not assume you can relocate your child while an objection is pending. Washington law restricts changing the child’s principal residence during certain stages of the relocation process without court authorization, subject to applicable exceptions. In some cases, a parent may request a temporary order allowing relocation while the case is pending. A Washington relocation lawyer can help determine what your existing order and the circumstances of your case allow before you move.

A child relocation may require a new or modified parenting plan if the distance makes the existing residential schedule impractical. Long-distance arrangements often need to address school-year parenting time, summers and holidays, transportation costs, travel logistics, and parent-child communication. Parents may agree on a revised schedule through negotiation or mediation. If they cannot agree, the court may determine appropriate parenting plan changes in connection with the relocation case.

Yes, a proposed international move may involve Washington’s relocation process when a Washington court order governs the child’s residential time or visitation. International moves can also raise additional issues involving travel, jurisdiction, enforcement of parenting orders, and the practicality of maintaining the child’s relationship with the other parent. Pursuit Family Law advises clients on Washington family law issues. When a relocation raises questions governed by another country’s laws, appropriate foreign counsel may also be needed.
