The main difference between legal separation and divorce in Washington is that legal separation does not end the marriage. A legal separation decree can address property division, debts, spousal maintenance, child support, and parenting arrangements, but the spouses remain legally married. Divorce, or dissolution of marriage, legally ends the marriage. Which option makes sense depends on your circumstances and what you want the legal process to accomplish.
Washington law does not require spouses to complete a specific period of physical separation before filing a petition for legal separation. A legal separation proceeding begins by filing a petition in superior court, and Washington law allows the proceeding to be filed in the county where the petitioner resides. Our law firm can help determine where to file and what information and court forms your particular case requires.
Not necessarily. However, the type of final decree depends on what each spouse requests. Washington law provides that if a petitioner requests legal separation instead of dissolution, the court enters the decree in that form unless the other party objects and petitions for dissolution or a declaration of invalidity. If you and your spouse disagree about whether to separate or divorce, an attorney can explain how the competing requests may affect the case.
Yes. Temporary orders may address financial and parenting needs while a Washington legal separation case is pending. Depending on the circumstances, temporary orders can cover child support, spousal maintenance, parenting arrangements, and certain protections involving property or conduct during the case. Washington’s legal-separation statutes expressly provide mechanisms for temporary support and parenting orders. These orders are temporary and are distinct from the terms ultimately included in a final decree.
Possibly, but legal separation does not guarantee continued health insurance coverage. Whether a spouse can remain covered depends on the particular health plan, employer rules, policy terms, and other circumstances. If maintaining insurance is one reason you are considering legal separation instead of divorce, confirm the plan’s rules before relying on continued coverage. A family law attorney can advise on the Washington legal issues, while the plan administrator or benefits provider can explain coverage requirements.
A legal separation decree can allocate responsibility for debts between spouses, but you should not assume that a family court order automatically eliminates obligations to outside creditors. Creditor rights and responsibility between spouses can be different issues. If debt is an important reason for seeking legal separation, identifying existing accounts, liabilities, and ongoing financial obligations early can help your legal team develop appropriate separation terms.
Yes. No earlier than six months after the decree of legal separation is entered, either party may ask the court to convert it to a decree of dissolution. Washington law directs the court to convert the decree when the statutory requirements are met. The six-month period runs from entry of the legal separation decree. It is a Washington state rule, not a King County-specific waiting period.
Yes. Legal separation does not prevent spouses from reconciling. If you decide to resume your marriage after a separation decree has been entered, however, do not assume that existing court orders simply disappear. Because a decree may contain enforceable provisions concerning property, support, or parenting, speak with a family law attorney about what legal steps may be appropriate if your circumstances change.
